1. Acceptance of Terms These Terms & Conditions govern your use of Imagine Downunder Travel’s website, communications, and any travel arrangements made through us. Imagine Downunder Travel is a DBA of Colorwayz Cottage LLC, a Washington State corporation. By accessing our website, communicating with us, or purchasing any travel services, you agree to be bound by these Terms. If you do not agree, you should not use our website or services.
By agreeing to these Terms, you confirm that you are at least the age of majority in your state, country, or province of residence, or that you are the age of majority and have provided consent for any minor dependents to use our website or services.
All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code on our website are owned, controlled, or licensed by Imagine Downunder Travel or its partners and are protected by copyright, trademark, and other intellectual property laws. 2. Scope of Services Imagine Downunder Travel provides curated travel planning, long-stay travel guidance, itinerary design, and booking facilitation with third-party travel suppliers. Imagine Downunder Travel is an approved intermediary of Nexion Travel Group and operates through Nexion’s accredited systems and preferred vendor network. All reservations, payments, and confirmations are processed through Nexion Travel Group’s preferred suppliers, and all supplier terms and conditions apply to every booking.
We reserve the right to limit sales of products or services to any person, region, or jurisdiction, to limit quantities, to change product descriptions, pricing, or availability at any time without notice, and to refuse or cancel any order at our discretion. Restrictions may apply to orders using the same customer account, credit card, billing address, or shipping address. If changes or cancellations occur, we may attempt to notify you using the contact information provided at booking.
3. Photo & Media Consent By participating in any tour, event, or travel experience arranged by Imagine Downunder Travel, you grant us permission to use photos or videos you provide to us and photos or videos taken by us during tours or travel experiences. These may be used for marketing, social media, website content, or promotional materials. If you do not consent, you must notify us in writing prior to travel.
4. Payment Information & Fraud Prevention Imagine Downunder Travel does not store or retain your credit card details. All payments are processed securely through third-party payment processors. To protect yourself from fraud, we strongly recommend paying travel suppliers using credit cards rather than debit cards. Imagine Downunder Travel will never request payment via cryptocurrency, cash, gift cards, or unverified wire transfers. If you receive any suspicious request, contact us immediately.
5. Travel Insurance Requirements We strongly recommend purchasing comprehensive travel insurance seven to fifteen days before departure to ensure eligibility for maximum coverage. Travelers are solely responsible for meeting all insurance company deadlines, disclosing pre-existing medical conditions, and complying with insurer requirements. Imagine Downunder Travel is not liable for denied claims resulting from failure to meet insurer timelines or disclosure requirements.
6. Consumer Disclosure Notice Imagine Downunder Travel acts solely as an intermediary between you and independent third-party travel suppliers, including airlines, hotels, tour operators, and transportation providers. We are not responsible or liable for any errors, omissions, gaps, schedule changes, cancellations, or service failures by any third-party supplier. We are also not responsible for luggage loss, delays, damage, accommodation issues, tour changes, or any service that does not meet original expectations.
All suppliers are independent entities and are not employees, agents, or partners of Imagine Downunder Travel. You agree to indemnify, defend, and hold harmless Imagine Downunder Travel, Colorwayz Cottage LLC, and its agents from any claims, losses, damages, or expenses arising from the acts, omissions, errors, or service failures of any third-party supplier.
7. Scam Awareness & Customer Safety Travelers should remain vigilant against online scams. Always pay with a credit card, verify payment requests directly with us, and avoid sending money to unknown third parties. Imagine Downunder Travel will never request money for travel services outside of approved, secure payment channels.
8. Limitation of Liability Imagine Downunder Travel does not own, control, or operate any transportation providers, hotels, tour operators, or other travel suppliers. We are not liable for any loss, damage, injury, delay, or expense arising from acts or omissions of travel suppliers, negligence, breach of contract, misconduct, acts of God, force majeure, strikes, government actions, weather, mechanical failures, construction, civil unrest, or terrorism. All services are provided “as is” and “as available,” without warranties of any kind. Our maximum aggregate liability, under any legal theory, shall not exceed five U.S. dollars ($5.00). Some jurisdictions may not allow certain limitations; portions of this section may not apply.
9. Disclaimer of Risk By using our services, you agree to assume all risks associated with travel and to hold Imagine Downunder Travel, its affiliates, employees, and agents harmless from any claims, losses, or liabilities arising from your travel or reliance on provided information. Imagine Downunder Travel acts solely as a booking agent and does not control operations, pricing, itineraries, or service delivery of independent suppliers.
10. Pricing & Availability All pricing and availability are subject to change without notice and are based on information provided by third-party suppliers. Taxes on hotel and car transactions represent recovery of applicable taxes paid to suppliers. Imagine Downunder Travel is not the entity that collects or remits taxes to authorities. We reserve the right to correct errors, inaccuracies, or omissions at any time without prior notice.
11. Miscellaneous These Terms operate to the fullest extent permissible by law. If any provision is unlawful, void, or unenforceable, it shall be severable without affecting the remaining provisions. These Terms constitute the entire agreement between you and Imagine Downunder Travel regarding use of our website and services and shall be governed by the laws of the State of Washington.
